Terms of Use

1. Introduction

We, Andrii Kryshtal (“Provider”), operating in the United Kingdom, have developed the software solution NICH – GPT Anonymizer (“NICH”). NICH comprises two inseparable components:

NICH Server, which runs locally on your computer (requires Windows 10 or later, or macOS);
The Google Chrome extension “NICH: GPT Anonymizer” (requires Google Chrome).

Both components are necessary for the anonymisation functionality. NICH enables you to anonymise text content before sending it to GPT services or other external platforms, helping protect your privacy by removing sensitive information.

By installing, accessing, or otherwise using NICH, you confirm that you accept and agree to be bound by these Terms of Use (the “Agreement”).

2. Scope of Use

2.1 Free and Premium Tiers

Free Tier: You may use NICH up to 10 times per day without charge.
Premium Tier: For use beyond the free tier limits, you need a paid subscription tied to your Google Chrome account. Only logged-in users can access the Premium Tier. You may use your subscription on any computer where you are signed into that Google account.

2.2 Subscription Details

Monthly Renewal: Subscriptions renew automatically each month.
Annual Subscription: There is also an annual subscription option available.
Cancellation: You may cancel your subscription at any time. If you cancel, your subscription remains active until the end of the already paid period.
Payment Processing: All payments are securely processed via Stripe.

Nichtech reserves the right to alter pricing and other conditions. We may also change subscription rules and will notify users accordingly.

3. Licence and Restrictions

The Provider grants you a limited, non-exclusive, non-transferable, revocable licence to install and use NICH (both NICH Server and the Google Chrome extension) solely for your personal or internal business purposes, in accordance with this Agreement.

You agree to the following restrictions:

Not to Reverse Engineer: You must not reverse engineer, decompile, or disassemble NICH.
Not to Circumvent Security: You must not use NICH to bypass or undermine any website’s terms of service or security measures.
Not to Modify: You must not modify NICH or create derivative works based on NICH, unless explicitly permitted by this Agreement or applicable law.
Not to Exceed Usage Limits: You must not exceed daily usage limits (whether free or premium) using automated tools or scripts.

4. Data Processing and Privacy

4.1 Local Processing

NICH Server runs locally on your computer and carries out anonymisation on your device. Your original and anonymised text remain on your computer; they are never transmitted to our servers. Any data you choose to send to GPT services or other external networks after anonymisation is your sole responsibility.

4.2 Provider’s Data Collection

In Nichtech we value data privacy and security and collect minimal information to improve NICH, such as:

Basic usage statistics (e.g., number of anonymisations).
Technical information (e.g., browser version, extension errors).
Approximate location (country only, based on IP address).

We never collect your original or anonymised text content.

4.3 Data that we keep

We keep your email address (as registered in Google Chrome) for subscription and account management, as well as for sending you important updates and notifications including about changes to the terms of use. We will not use it for marketing or any other purposes without your explicit consent.

5. User Responsibilities

5.1 Reviewing Anonymised Content

We strive to achieve a high level of anonymisation (up to 90% accuracy in tests). However, omissions or errors may occur. You must review the anonymised text to ensure it meets your requirements before sending it onward.

5.2 Content Ownership and Copyright

You are solely responsible for the content of any texts you use for anonymisation. Nichtech (the Provider) shall not be liable if you anonymise texts that infringe copyright, violate third-party rights, or in any similar situations.

5.3 Responsibility for Sent Data

Once anonymised content leaves your device (for example, when sent to GPT services or other networks), it is entirely your responsibility.

6. System Requirements

NICH Server: Requires Windows 10 (or later) or macOS 14 (or later) Apple Silicon.
Google Chrome Extension: Requires Google Chrome.
Logged-In Users: Your subscription is tied to the Google account you use to sign in. You can only use NICH (beyond the free limit) when logged into that account.

7. Usage Limits

Free Tier Limit: 10 anonymisations per day.
Token Limit for Premium Tier: The maximum amount of text that can be anonymised at once is 2,048 tokens.

8. Warranty Disclaimer

NICH is provided “as is” and “as available”. To the fullest extent permitted by law, the Provider disclaims all warranties, whether express or implied, including but not limited to warranties of fitness for a particular purpose, merchantability, and non-infringement.

You acknowledge:

That the anonymisation process may sometimes miss or over-anonymise content.
That the Provider does not warrant NICH will meet your requirements or operate uninterrupted, timely, securely, or error-free.

9. Liability and Indemnity

9.1 Limitation of Liability

To the extent permitted by law, the Provider shall not be liable for:

Loss or damage resulting from errors or omissions in anonymised text.
Indirect, special, incidental, or consequential damages.
Loss of profit, revenue, data, or goodwill, whether direct or indirect.

9.2 User Responsibility

You agree to assume full responsibility for reviewing anonymised text and for all content you choose to send through GPT services or similar platforms.

9.3 Indemnification

You will indemnify and hold the Provider harmless against any claims, actions, proceedings, losses, damages, expenses, and costs (including court costs and legal fees) arising out of or in connection with your use of NICH.

10. Dispute Resolution

If you have any concerns or disputes regarding NICH or this Agreement, please contact the Provider directly:

If a dispute remains unresolved, it shall be governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction unless you have a place of jurisdiction in another EU member state.

11. Changes to this Agreement

We may update this Agreement to:

Reflect changes in how NICH operates.
Meet legal requirements.
Address new features or policies.

When we make significant changes, we will notify Premium Tier users (via the extension and/or email) before they take effect. Free Tier users are encouraged to review this Agreement regularly for updates.

12. Support and Contact

12.1 Technical Support

If you encounter technical issues:

Refer to our troubleshooting guide in the Help section of NICH.
Contact our support team at anonymizer@nichtech.uk. We aim to respond within 48 business hours.

For urgent privacy-related issues, we will prioritise responses as quickly as possible.

13. Your Rights

As a user of NICH, you have the right to:

Use the Free Tier without providing personal information beyond what Google Chrome inherently collects for extension functionality.
Cancel your Premium subscription at any time.
Request the deletion of your account and any associated data we hold (e.g., your email address).
Receive notification of significant changes to these terms.
Contact us with questions or concerns about your privacy or these Terms.

14. Final Provisions

In the event any provision of this Agreement is deemed invalid, unenforceable, or unlawful, all remaining provisions shall remain in full force and effect. No failure or delay by the Provider in exercising any right under this Agreement shall constitute a waiver of that right.

By installing or using NICH, you confirm that you have read, understood, and agree to the above terms.
